Terms and Conditions – Sales Mama, LLC

These Terms and Conditions govern all products, programs, courses, workshops, coaching, consulting services, digital downloads, and retreats offered by Sales Mama, LLC (“Company,” “we,” “us,” or “our”). By purchasing, enrolling, or participating in any offering, you acknowledge that you have read, understood, and agree to these Terms and Conditions.

1. Agreement to Terms

By enrolling in any program, coaching, retreat, or digital product, you agree to comply with these Terms and Conditions. If you do not agree, do not purchase or participate.

2. Participation Eligibility

  • Must be 18 years or older.
  • Registration and payment (or first installment of a payment plan) must be completed to secure access.
  • Access is non-transferable and for the sole use of the purchaser.

3. Payments, Refunds, and Cancellations

3.1 Payment Policy

Full payment is required unless an approved payment plan is selected.

Payment plans are contracts, not subscriptions. All installments must be completed regardless of participation.

  • Failed or late payments result in immediate suspension of access.
  • A $50 late fee is applied after 5 days past due.
  • A $100 reactivation fee applies if access is paused due to non-payment.

If 14 days pass with no payment and no communication, the account is considered abandoned. All services are permanently revoked and the remaining balance becomes due in full. The account may be sent to collections.

3.2 Refund Policy

Digital Programs and Products

All digital sales are final and non-refundable.

Retreats

  • Cancel within 48 hours of booking: full refund.
  • Cancel within 30 days of booking: 50% refund.
  • Cancel after 30 days: no refund.
  • Retreat deposits are non-refundable and non-transferable unless otherwise stated.

3.3 Missed Appointments

  • 1:1 sessions must be rescheduled at least 48 hours in advance.
  • No-shows or same-day cancellations are forfeited.
  • Emergencies may be reviewed on a case-by-case basis but are not guaranteed rescheduling.

3.4 Chargebacks

  • You agree not to initiate a chargeback on any payment.
  • Attempted chargebacks will be disputed, and your account may be sent to collections.
  • All digital access is revoked upon a chargeback attempt.

4. Product Types and Access

  • Workshops: Includes the scheduled session and specified materials. Replay access is only available while enrolled.
  • Courses: Lifetime access unless otherwise specified.
  • Coaching: Includes only the sessions outlined at purchase. Additional sessions require an additional fee.
  • Retreats: Governed by retreat-specific policies and agreements.

5. Intellectual Property

All materials, curriculum, videos, scripts, workbooks, and content are the sole property of Sales Mama, LLC.

You may not:

  • Copy, distribute, share, or publish program materials.
  • Use materials to create competing programs, content, or coaching.
  • Reproduce, repurpose, or adapt any content for commercial use.

Violation may result in immediate removal without refund and legal action.

6. Confidentiality

  • Participants agree to maintain confidentiality within all programs, coaching spaces, and community forums.
  • Screenshots, discussions, and shared materials may not be distributed outside the program.
  • We do not share your personal information without consent unless required by law.

7. Code of Conduct

  • Respectful and professional behavior is required.
  • Harassment, discrimination, or disruption will result in removal without refund.
  • The Company reserves the right to deny access to anyone who violates community standards.

8. Results Disclaimer

  • Results vary. No income, sales, or business outcomes are guaranteed.
  • Any success examples are for illustration only.
  • Coaching is not therapy, financial advising, or legal counsel.

9. Limitation of Liability

You agree that Sales Mama, LLC is not liable for:

  • Business decisions
  • Financial losses
  • Missed opportunities
  • Consequences of implementing program teachings

You waive any right to claim damages or losses related to participation.

10. Data Privacy and Security

  • Only necessary personal and payment information is collected.
  • Payments are processed securely by third-party providers.
  • We do not store full payment information.

11. Force Majeure

The Company is not responsible for delays or inability to deliver services due to events beyond our control, including natural disasters, illness, technology outages, or other unforeseeable circumstances.

12. Informed Consent

By enrolling, you acknowledge that business and personal development may involve emotional, mental, and financial challenges. You engage voluntarily and understand that results are not guaranteed.

13. Dispute Resolution

  • All disputes are governed by the laws of the State of Oregon.
  • Participants agree to attempt resolution via written communication before pursuing legal action.
  • Mediation or arbitration may be required prior to court proceedings.

15. Community and Access Boundaries

  • Direct messaging the coach for coaching or personalized feedback is not included unless explicitly stated.
  • Questions must be submitted through designated community platforms, comment sections, or Q&A calls.
  • Response times are not guaranteed and are provided within posted business hours.
  • Excessive messaging, boundary pushing, or misuse of access may result in removal without refund.

16. Technology and Platform Responsibility

  • Participants are responsible for maintaining access to login credentials and required technology.
  • The Company is not liable for third-party platform outages, replay errors, or access issues outside our control.
  • Failure to maintain login access does not excuse missed content or payments.

17. Schedule Changes and Availability

  • The Company may reschedule calls, adjust dates, or replace guest speakers as needed.
  • Changes do not qualify participants for refunds or compensation.

18. Testimonials, Media, and Promotion Consent

  • By participating, you grant permission for your testimonials, wins, or feedback to be used for marketing unless you request otherwise in writing.
  • Retreats and live events may be recorded or photographed. Attendance constitutes consent unless you notify us in writing beforehand.

19. No Therapeutic, Legal, or Financial Relationship

  • The coaching relationship is not therapy or professional advising.
  • The Company does not act as a CPA, lawyer, financial advisor, or mental health professional.
  • All decisions made based on program teachings are your responsibility.

20. Collections and Outstanding Balances

  • Accounts past 30 days overdue may be sent to collections.
  • Collection fees, attorney fees, and administrative costs will be added to the outstanding balance.
  • Payment obligations remain regardless of participation level.

21. No Pausing, Freezing, or Extensions

  • Access to programs, coaching, or community spaces cannot be paused, frozen, or extended.
  • Payments must be completed even if participation stops.
  • Failure to participate does not grant additional access or credit.

22. Communication Expectations

  • Emails and messages are responded to within 48–72 business hours.
  • Weekends, holidays, and travel days are excluded from response times.
  • Abuse of communication channels may result in removal without refund.

23. Program Modifications

  • The Company may update, modify, add, or remove program content at any time.
  • These updates do not entitle participants to refunds or continued access to outdated materials.

24. Non-Transferability, Sharing, and Non-Competition

  • Program access, logins, and materials may not be shared or transferred.
  • You agree not to create competing programs using any Company materials.
  • Violations may result in legal action and removal without refund.

25. Termination by Company

  • Sales Mama, LLC may terminate participation for violating any Terms or community guidelines.
  • Termination does not entitle you to a refund.
  • Remaining payments will still be owed.

26. Earnings Disclaimer

  • No earnings or client acquisition results are guaranteed.
  • Past results do not guarantee future performance.
  • You are responsible for implementing strategies to achieve outcomes.

27. Media Release for Retreats and Events

  • Retreats and events may be recorded or photographed for marketing and training.
  • By attending, you consent to the use of your image unless you notify the Company in writing prior to the event.

28. Retreat Medical and Physical Release

  • Retreats may involve physical activity including walking, horse interactions, and outdoor experiences.
  • You assume all risks associated with participation and release the Company from liability for injuries or physical strain.
  • Participants must disclose any medical conditions that may impact engagement.

29. Travel and Accommodation Disclaimer

  • Participants are responsible for their own travel, transportation, and lodging unless otherwise stated.
  • The Company is not liable for travel disruptions, cancellations, or issues with third-party accommodations.

30. Entire Agreement

  • These Terms and Conditions constitute the entire agreement between you and Sales Mama, LLC.
  • No verbal promises or external statements are binding.
  • The Company may update these Terms at any time, and continued participation constitutes acceptance.

By completing your purchase, you confirm that you have read, understand, and agree to these Terms and Conditions. Your purchase constitutes a binding agreement with Sales Mama, LLC, and you agree that all sales are final, all payment plan installments are owed in full, and access is governed by the policies outlined above.
